These Terms of Use ("Terms") govern your use of the Silent Reflux: LPR Diary app (the "App") provided by [YOUR LEGAL NAME OR COMPANY] ("we", "us"). By downloading or using the App, you agree to these Terms and to Apple's Standard End User License Agreement (EULA), which is incorporated here by reference. Where these Terms and Apple's Standard EULA conflict, Apple's Standard EULA controls for App Store distribution.
1. License
We grant you a personal, non-transferable, non-exclusive, revocable license to use the App on Apple devices you own or control, in accordance with Apple's Standard EULA and these Terms.
2. Medical disclaimer
- The App helps you record and review your own symptoms, meals, timing, and notes. Any charts, patterns, or summaries are informational only.
- The App does not diagnose laryngopharyngeal reflux (LPR), GERD, or any other condition, and does not recommend or replace medical treatment.
- Never disregard professional medical advice or delay seeking it because of something in the App. If you think you have a medical emergency, contact your doctor or emergency services.
3. Subscriptions and purchases
The App offers an auto-renewable subscription and, where available, a one-time lifetime purchase. All purchases are processed by Apple through the App Store and are subject to Apple's terms. For auto-renewable subscriptions:
- Payment is charged to your Apple Account at confirmation of purchase.
- The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel your subscription in your Apple Account settings after purchase. Deleting the App does not cancel a subscription.
- Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.
Refunds are handled by Apple according to Apple's refund policy.
4. Acceptable use
You agree not to misuse the App, attempt to reverse engineer it except as permitted by law, or use it in any way that violates applicable laws.
5. Your data
Your entries are stored on your device and, if enabled, in your private iCloud account. You are responsible for maintaining your own backups. See our Privacy Policy for details.
6. Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that any insight it surfaces is accurate or complete.
7. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages, or for any health decisions made in reliance on the App. Nothing in these Terms limits liability that cannot be limited under applicable law.
8. Changes
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
9. Governing law
These Terms are governed by the laws of Turkey, without regard to its conflict-of-laws rules, except where mandatory consumer-protection law of your country of residence applies.
